Qui tacet consentire videtur

The Daily Signal has reported that “[T]he six Senate Republicans who voted to confirm Homeland Security Secretary Alejandro Mayorkas declined to criticize him after the revelation that he knew Border Patrol agents didn’t “whip” Haitian migrants before he publicly spoke as if they did.”


We now know that the claim by Mayorkas that the Border Petrol agents had whipped migrants was flatly false – it was a lie. That lie, of course, was repeated frequently by the empty suit who occupies the White House. Whether he knew the claim was false or was simply reading the teleprompter placed in front of him by his managers we do not know.


What we do know, beyond dispute, is that the allegation from Mayorkas and repeated by Mr. Biden and his functionaries was a lie. We also know that not one of them has apologized to the American people or to the Border Patrol agents for the lie. The libel of their characters remains.


So who are the six Senate Republicans who lack the cajones to speak up to criticize both Mr. Mayorkas and Mr. Biden. Ratcatcher believes that when public officials fail in their duty, they ought to be identified. These people have failed. First, they failed by voting to confirm a known radical partisan as Homeland Secretary. More recently, they have failed to criticize him and demand his apology. The Senators are Shelley Moore Capito of West Virginia; Susan Collins of Maine; Lisa Murkowski and Dan Sullivan of Alaska; Rob Portman of Ohio; and Mitt Romney of Utah.


The legal maxim, Qui tacet consentire videtur, ubi loqui debuit ac potuit (He who is silent, when he ought to have spoken and was able to, is taken to agree), fits here. These Senators, by their silence, can reasonably be understood to approve the lies of Mayorkas and Biden and the libel of the Border Patrol agents and their refusal to apologize. Shame on them.
